These General Terms and Conditions (“GTC”) apply to orders and bookings of brewery tours by the customer via the website www.ottakringerbrauerei.at, as well as to booking requests for private group tours sent to fuehrungen@ottakringer.at. The contractual partner of the customer is Ottakringer Betriebe- und DienstleistungsgmbH, Ottakringer Platz 1, 1160 Vienna (“Ottakringer”). Orders and bookings of brewery tours via the website, as well as booking requests for private group tours, are made exclusively on the basis of these GTC. Divergent conditions or declarations by the customer are not valid.
The customer declares their consent and bindingness to these GTC by placing an order, making a booking, or sending a booking request for private group tours. Ottakringer is entitled at any time to amend or supplement these GTC. The GTC applicable at the time of the order/booking/request always apply.
The GTC apply both to consumers and businesses. In legal transactions with consumers they apply insofar as mandatory statutory provisions do not conflict.
The contract language is exclusively German.
The goods and services (tours including tastings) described on the website are non-binding and without obligation — they do not constitute an offer by Ottakringer. Only when the customer submits a binding order by clicking “payment-obliged order” at the end of the ordering process, or — in the case of exclusive private group tours — by sending a booking request to fuehrungen@ottakringer.at, does the customer submit a legally binding offer. Ottakringer is not obliged to accept this offer.
The customer receives an order or booking confirmation. The contract is concluded only upon delivery of the goods or upon sending the order confirmation for the service to the e-mail address provided by the customer.
Ottakringer does not guarantee the availability of the goods described on the website or that tours including tastings will take place.
The contract is subject to the condition that the customer has reached the age of 16 when ordering alcoholic beverages. Ottakringer reserves the right to refuse delivery to minors.
Vouchers
A voucher received can be redeemed either by the customer or transferred to a third party. The voucher can only be redeemed once.
The voucher is only valid for the specific service (tour including tasting) selected by the customer. If the customer withdraws from the contract before redeeming the voucher, the voucher cannot be redeemed.
The voucher is valid for one year from the conclusion of the contract. Redeeming for cash is excluded.
All prices shown on the website include all taxes and, depending on the destination, all costs associated with delivery. The prices valid at the time of the order apply.
Deliveries of goods and vouchers for services via postal mail are free of shipping costs within Austria. For deliveries to Germany, shipping fees of EUR 12 (including VAT) apply. For electronic delivery of booking confirmations for services no shipping costs apply.
The purchase price is due immediately after placing the order by clicking “payment-obliged order.”

Payments are processed via the payment service provider PAYONE according to current security standards (3-D Secure 2.0).
For booking a brewery tour or a voucher for a tour via their booking tool, the following payment methods are possible:

Ordered goods remain property of Ottakringer until full payment by the customer.
Cancellation/Refund Conditions for Regular Tours:
Cancellation less than 24 hours before the start: No refund of the already paid amount.
Cancellation between 24 and 72 hours before start: No refund either. However, a one-time date change is possible, or alternatively a voucher equal to the already paid amount can be issued. For cancellations after a date change, general cancellation conditions apply.
Cancellations 72 hours or more before the start of the tour: The amount already paid will be fully refunded.
For Exclusive (Private) Group Tours:
Cancellation within less than 24 hours before the start is not possible — the full amount is due.
Cancellation between 24 and 72 hours before start: A full cancellation is not possible — 50 % of the total amount are charged.
Cancellation 72 hours or more before start: No service is charged.
Special Rule for Exclusive Private Group Tours:
When sending the booking request, the customer must state the exact number of participants. Changes to the number of participants are possible up to 72 hours before start. If the number is reduced less than 72 hours before start, the amount to pay is calculated based on the originally stated number of participants.
Late Arrival:
The customer must appear punctually at the booked tour time. Tours start on time — in case of delay, participation cannot be guaranteed. If the customer cannot attend due to lateness, no refund of the already paid amount is possible. For private group tours the full amount remains payable.
Bad Weather:
Tours take place in any weather. Bad weather does not entitle the customer to withdraw from the contract. No refund of the paid amount.
Cancellation by Ottakringer (Reservation Conditions):
Ottakringer reserves the right to cancel or postpone tours without giving reasons. If the customer does not accept alternative dates, Ottakringer will refund the amount paid for the tour.
Safety Instructions / Conduct:
Customers must follow the (safety) instructions of Ottakringer. Unsupervised access to certain areas is prohibited. Customers must stay with the group. Ottakringer reserves the right to exclude customers, especially in cases of rule violations, inappropriate or intoxicated behavior. No refund will be given in such cases. Entry and usage of the premises are at the customers’ own risk. Ottakringer accepts no liability. Heavily intoxicated or clearly substance-impaired persons may be refused participation from the start.
Supervision of Children and Minors:
Children and minors may only participate under supervision by their legal guardians. Ottakringer accepts no responsibility for supervision. The customer must ensure that minors do not leave the designated paths or group.
Smoking Ban: On the entire premises a smoking ban applies — except in designated areas.
Food: Bringing in or consuming food is prohibited.
Animals on the Premises: Animals are not allowed on the entire premises.
Guide Dogs / Assistance Dogs: For guide- or assistance dogs for disabled persons, the owner must show a disability pass and proof of the dog’s qualification. On the premises, guide dogs must wear a harness.
Photography / Filming / Recording:
Any recordings — photo, audio or video — regardless of medium or purpose, may only be made after consultation and with express consent of Ottakringer. In case of recordings, the customer is responsible to ensure compliance with applicable laws, in particular concerning privacy/data-protection rights of other participants; this applies irrespective of whether the recordings are meant for publication.
Consumers within the meaning of consumer protection law can withdraw from this contract within 14 days without giving reasons. The withdrawal can also be partial.
The withdrawal period begins on the day the customer or a designated third party (not the carrier) takes possession of the goods or receives the order confirmation for the service.
Withdrawal can be declared by sending an unequivocal statement to Ottakringer (e.g. by email or letter). The standard withdrawal form may be used but is not mandatory.
If the service (e.g. tour) was already used, withdrawal is excluded.
Consequences of Withdrawal:
If the customer withdraws, Ottakringer will refund all payments received, including delivery costs (except for additional costs if the customer chose a non-standard delivery method). Refund is immediate and at latest within 14 days after receipt of withdrawal. The same payment method used in the original transaction will be used, unless otherwise agreed. No costs will be charged for the refund.
If Ottakringer did not offer to collect the goods themselves in the event of withdrawal, Ottakringer may refuse refund until the goods or vouchers are returned or until proof of return is provided, whichever occurs first. Direct costs of return shipment will be borne by Ottakringer.
Exceptions (No Right of Withdrawal)
The withdrawal right does not apply to:
Goods manufactured according to customer specifications or clearly tailored to personal needs.
Goods that perish quickly or whose expiration date would be rapidly exceeded.
Sealed goods that are not suitable for return after unsealing, for hygiene or health reasons — if the seal was removed after delivery.
Goods irreversibly mixed with other items after delivery.
Alcoholic beverages whose price was agreed at contract conclusion, that cannot be delivered earlier than 30 days after conclusion, and whose current value depends on market fluctuations beyond the supplier’s control.
Contracts for delivery of food, beverages or other everyday household goods, when delivery is made regularly to the consumer’s home, workplace or habitual residence.
Services, if the service has already been fully performed — in those cases the right of withdrawal only exists if, before the service begins, the consumer explicitly agreed that performance begins before expiry of the withdrawal period.
There is a standard withdrawal form available.
Statutory warranty provisions apply. Liability for consequential damages is excluded.
Compensation claims are limited (except in case of personal injury) to gross negligence and intent. Additional claims (e.g. indirect damages, lost profits, third-party claims) are excluded.
For tours, Ottakringer accepts no liability for items brought onto the premises (e.g. clothing, valuables).
For customers who are entrepreneurs, gross negligence must be proven for any damage claims. Claims expire 12 months after knowledge of damage and damaging party.
All distributed products comply with relevant Austrian laws regarding condition (e.g. minimum shelf life) and labelling.
If the customer exports goods outside Austria, they bear sole responsibility for complying with laws abroad (food, labelling, consumer protection, competition law) and must hold Ottakringer harmless.
Ottakringer processes personal data only where legally permitted, applying appropriate technical and organizational measures and only to the extent necessary. Data will not be passed on to third parties without the customer’s consent — except where legally obliged to do so.

In case of disputes, the customer has the option to participate in the mediation procedures of the Internet Ombudsstelle and the OS‑Plattform.

Severability Clause

Place of Fulfilment / Applicable Law / Jurisdiction
Place of fulfilment for all services is Vienna. Austrian law applies, excluding conflict-of-law rules of private international law and the UN Convention on Contracts for the International Sale of Goods. Exclusive jurisdiction for all disputes is the competent court in Vienna.

Additional Conditions for Events at Ottakringer – Company events and private parties
These General Terms and Conditions (“GTC”) apply to all orders, purchases and bookings made by customers through the website www.ottakringerbrauerei.at, including the booking of brewery tours and the rental of event spaces. The contractual partner is:

By placing an order, booking a tour, or submitting a request for a private group tour, the customer accepts these GTC in full. Ottakringer reserves the right to amend the GTC at any time. The version valid at the time of ordering applies.
These GTC apply to both consumers and businesses. Mandatory consumer protection regulations remain unaffected.
Schriftliche Anbote von der Ottakringer Betriebe- und DienstleistungsgmbH („OBD“) sind prinzipiell freibleibend, außer sie werden ausdrücklich als verbindliche Anbote bezeichnet. Mündliche Anbote bzw. mündliche Zusagen von OBD Mitarbeitern sind nur dann wirksam, wenn sie von OBD schriftlich bestätigt werden.
Ist eine Verrechnung nach teilnehmenden Personen vereinbart, so hat der Kunde mindestens 5 Werktage vor Beginn der Veranstaltung der OBD die Anzahl der teilnehmenden Personen bekannt zu geben. Die OBD ist berechtigt, selbst oder durch eine von ihr beauftragte Person die Anzahl der tatsächlich teilnehmenden Personen durch Zählung zu ermitteln. Die Verrechnung erfolgt dann aufgrund der so festgestellten Anzahl von Teilnehmern, wobei aber die vom Kunden ursprünglich angegebene Anzahl von Teilnehmern jedenfalls verrechnet wird.
Akontozahlung:
Kunden haben bis 2 Wochen vor Veranstaltungsbeginn eine Anzahlung in der Höhe von 80% des zu erwartenden Umsatzes laut letztgültigem Angebot auf das in der Anzahlungsrechnung angeführte Konto zu zahlen. Die Anzahlung wird dem Kunden in der Endabrechnung gutgeschrieben.
Endabrechnung:
Nach der Veranstaltung erfolgt die endgültige Berechnung des Entgeltes der Mieten und Nebenleistungen zuzüglich der Umsatzsteuer in der zu diesem Zeitpunkt gesetzlichen Höhe. Der sich aus der Abrechnung ergebene Saldo ist binnen 14 Tagen ab Rechnungsdatum fällig bzw. wird von der OBD auf ein vom Kunden namhaft gemachtes Konto refundiert.
Zahlungsverzug:
Bei Zahlungsverzug behält sich die OBD das Recht vor, Zinsen in der Höhe von 12% pro Jahr in Rechnung zu stellen.
Rücktritt vom Vertrag:
Die OBD ist berechtigt, jederzeit vom Vertrag zurückzutreten, wenn vereinbarte (Akonto-)Zahlungen nicht rechtzeitig eintreffen, wenn bekannt wird, dass die Veranstaltung bestehenden Gesetzen widerspricht oder der Kunde gesetzliche Bestimmungen oder behördliche Auflagen nicht einhält, wenn sich herausstellt, dass durch die Veranstaltung der Ruf oder die Sicherheit der Ottakringer Event Location bzw. Ottakringer Brauerei oder die öffentliche Ordnung gefährdet werden oder wenn die Veranstaltungsräume aufgrund höherer Gewalt oder technischer Gebrechen nicht zur Verfügung gestellt werden können.
Der Kunde hat in diesen Fällen keinen Anspruch auf Entschädigung gegen die OBD.
Stornobedingungen:
Ab Annahme des Anbots beträgt die Stornogebühr 50% und innerhalb von 3 Monaten (90 Tage) vor der Veranstaltung 100% der Anbotssumme.
Sämtliche zur Verfügung gestellten Räume, Flächen, usw. sind widmungsgemäß, sorgsam und pfleglich zu behandeln. Nach Ablauf der vereinbarten Zeit sind sie unter Berücksichtigung der üblichen Abnützung im gleichen Zustand zurückzustellen, in dem sie sich vor der Benützung befunden haben. Sämtliche etwaige baulichen oder sonstigen Veränderungen der Veranstaltungsräume bzw. der Einrichtungen sind nur nach vorheriger schriftlicher Genehmigung der OBD zulässig, wobei der Vertragspartner sämtliche diesbezüglichen Kosten zu tragen hat. Sofern eine Zustimmung zu Änderungen erteilt wird, hat der Kunde nach Ende der Veranstaltung den ursprünglichen Zustand auf seine Kosten wiederherzustellen.
Die Übergabe der Veranstaltungsräume erfolgt im Zuge einer Begehung, bei der sowohl der Kunde oder ein Bevollmächtigter und ein Vertreter der OBD anwesend sind. Allfällige Mängel sind bei sonstigem ausdrücklichen Verzicht des Kunden auf ihre spätere Geltendmachung unverzüglich anzuzeigen. Die Begehungstermine finden während der schriftlich vereinbarten Benützungszeit statt, d.h. Vor und nach Beginn bzw. Ende der Auf- bzw. Abbauzeit. Im Falle irgendwelcher Beschädigungen der Veranstaltungsräume (z.B. Wände, Fußböden, Leitungen und anderer technischer oder baulicher Einrichtungen) ist dies der OBD unverzüglich zu melden. Schäden, die aus der verspäteten Meldung resultieren, gehen zulasten des Kunden. Die Wiederherstellung bzw. Behebung der Mängel erfolgt zum nächstmöglichen Zeitpunkt auf Kosten des Kunden.

Orders of alcoholic beverages require that the customer is at least 16 years old. Delivery may be refused if age cannot be verified.
Vouchers may be redeemed by the purchaser or transferred to third parties. Each voucher is valid once and only for the specific service purchased (e.g. a brewery tour including tasting).
Vouchers expire one year from the date of purchase and cannot be exchanged for cash.
If the customer withdraws from the contract before redeeming the voucher, redemption is no longer possible.
All prices displayed include statutory taxes and applicable delivery charges.
Shipping within Austria is free of charge. Deliveries to Germany incur a flat shipping fee of EUR 12 (incl. VAT).
Electronic delivery of booking confirmations or vouchers is free of charge.

100% of the total amount is charged.
24–72 hours before start:
50% of the total amount is charged.
More than 72 hours before start:
No cancellation fee.
Participant numbers may be adjusted up to 72 hours before the tour. Later reductions will not reduce the amount payable.
Tours start on time.
In case of late arrival, participation cannot be guaranteed.
Paid fees are not refunded; private group tours remain payable in full.
Tours take place in all weather conditions. Poor weather does not entitle customers to cancellation or refund.
Ottakringer may cancel or postpone tours for operational reasons.
If no suitable alternative date is accepted, the paid amount will be refunded.
Customers must follow all instructions issued by Ottakringer personnel. Access to restricted areas is strictly prohibited.
Ottakringer may exclude participants for safety violations, inappropriate behaviour, or intoxication — without refund.
Participation is at the attendee’s own risk. Ottakringer assumes no liability for personal belongings brought onto the premises.
Minors may only participate under supervision of a parent or legal guardian.
Ottakringer does not assume responsibility for supervision.
Smoking is prohibited throughout the brewery premises, except in specifically designated outdoor areas.
Bringing and consuming food on the premises is not allowed.
Animals are not permitted.
Exceptions apply to certified guide and assistance dogs, which must wear a harness and be supported by official documentation.
Photo, film or audio recordings are permitted only with prior written consent from Ottakringer.
The customer is responsible for complying with data protection and privacy laws.
Guests and service providers may only use the rented event spaces.
Production areas of the brewery must not be entered at any time.
At events — particularly concerts and clubbings — the following items are prohibited:
weapons, sprays, fireworks, laser pointers, loud horns, skates, strollers, helmets, chairs, large bags, PET or glass bottles, all types of cameras or recording devices (unless authorized), selfie sticks, GoPros, and animals (except assistance dogs).
For public events, heavy coats and large bags must be deposited at the cloakroom.

Parking availability cannot be guaranteed unless explicitly arranged in advance.
Bicycles may be parked at designated areas.
E-scooters and e-bikes may not be brought into the premises.
Most event rooms are accessible, with the exception of the “Hopfenboden.”
Accessible parking is not guaranteed.
Consumers may withdraw from the contract within 14 days without giving reasons.
The withdrawal period begins when:
the customer (or a designated third party) receives the goods, or
the customer receives the booking confirmation for services.
A clear withdrawal statement must be sent to Ottakringer via email or letter.
A standard withdrawal form is available, though not mandatory.
Withdrawal is not possible for:
customised goods
perishable goods
goods sealed for hygiene reasons once unsealed
goods mixed inseparably with other items
alcoholic beverages subject to market value fluctuations
food/beverage deliveries to home or workplace
fully performed services where the consumer agreed to early performance
If the service (e.g. tour) has already been used, withdrawal is excluded.
Refunds will be issued within 14 days using the same payment method.
Statutory warranty rights apply.
Ottakringer is liable for damages only in cases of intent or gross negligence, except for personal injury.
Indirect damages, consequential losses and lost profits are excluded.
Customers exporting Ottakringer goods must comply with local laws abroad and indemnify Ottakringer against any related claims.
Personal data is processed only where legally permissible, applying appropriate technical and organisational measures.
Data is not shared with third parties unless required by law or with customer consent.
